Welcome to Good Weird Works.
These Terms of Service (“Terms”) govern your access to and use of the Good Weird Works website, creative services, subscriptions, trials, projects, and related offerings.
Good Weird Works (“GWW,” “we,” “us,” or “our”) provides on-demand creative services to businesses and professional users.
By accessing our website, purchasing a service, starting a trial, submitting a request, or otherwise using GWW, you agree to these Terms.
If you use GWW on behalf of a company or organization, you confirm that you have authority to accept these Terms on its behalf.

1. Our Services
Good Weird Works is an on-demand creative team providing creative strategy, direction, design, production, copy support, and related marketing services.
Depending on your plan or engagement, Services may include:
Advertising creative
Campaign creative
Landing pages and website sections
Presentations and pitch decks
Social media creative
Brand and marketing collateral
Sales enablement materials
Reports and infographics
Email and lifecycle creative
Short-form video and motion
Copy and messaging support
Creative strategy and direction
Other creative services agreed between you and GWW
The exact scope available to you depends on your selected subscription, trial, project, proposal, order, or other written agreement.
GWW may use team members, contractors, specialist creatives, technology providers, and other collaborators to provide the Services.
2. How GWW Works
Unless otherwise stated in your plan, GWW operates using an unlimited request queue with one active priority at a time.
You may add as many eligible creative requests as you like to your queue.
We generally work on one active priority at a time. When that request is completed, approved, paused, or moved back into the queue, the next request can begin.
Additional simultaneous workstreams may be offered separately.
What “unlimited requests” means:
“Unlimited requests” means you may continuously submit eligible requests to your queue.
It does not mean:
unlimited simultaneous projects;
unlimited completed work within any particular period;
unlimited production hours;
guaranteed completion of your entire queue during a billing period; or
unlimited work outside the scope of your plan.
Throughput depends on project complexity, revisions, client feedback, dependencies, and the active production capacity included in your plan.
3. Requests and Scope
Each request should represent a reasonably defined creative objective or deliverable.
Large or complex requests may be divided into milestones, stages, or multiple requests.
Examples may include:
large presentations;
multi-page websites;
campaign systems;
extensive reports;
complex video projects;
large brand systems; or
projects requiring multiple specialist skills.
A substantial change to the original brief, objective, format, or direction may be treated as a new request.
GWW may reasonably determine whether a request falls within the scope of your plan.
4. Turnaround Times
Any turnaround time shown on our website or communicated by GWW is a target or estimate, not a guaranteed deadline unless specifically confirmed by us in writing.
Standard requests may often receive an initial delivery within the turnaround period described for your plan.
More complex work may take longer or be delivered in stages.
Timelines may be affected by:
project complexity;
incomplete briefs;
missing assets;
delayed client feedback;
revisions;
changes in scope;
third-party dependencies;
technical issues; or
circumstances reasonably outside our control.
If you have a fixed launch date or hard deadline, please tell us before work begins.
5. Revisions
Where your plan includes unlimited revisions, this means reasonable revisions within the original brief and scope.
Unlimited revisions do not include unlimited new concepts, completely different creative directions, or substantial changes to the original objective.
A material change in direction may be treated as a new request and placed in your queue accordingly.
6. The 7-Day GWW Trial
Where available, GWW may offer a 7-Day Trial.
The trial is designed to let you experience the GWW service on real creative work before committing to an ongoing membership.
During the trial, you receive access to the applicable GWW experience for a week.
Unless otherwise stated:
You may add eligible requests to your queue.
One priority is worked on at a time.
Creative thinking, direction, and execution are included.
Revisions are available within the active scope.
Larger work may be broken into milestones.
Completion of every request placed in the queue during the 7-day period is not guaranteed.
Trial period
Your trial begins on the date confirmed during checkout or onboarding.
Client inactivity, delayed feedback, missing assets, or failure to submit requests do not automatically extend the trial.
Any extension must be approved by GWW.
No automatic renewal
The 7-Day GWW Trial is a one-time payment and does not automatically renew into a paid membership.
You will only become a recurring customer if you expressly choose to continue.
Trial credit
Where stated in the applicable offer, your trial payment will be credited toward your first qualifying GWW membership if you choose to continue within the applicable eligibility period.
Trial credits:
have no cash value;
are non-transferable;
may not be combined with another promotion unless approved by GWW; and
apply only to qualifying GWW memberships.
7. Memberships
GWW may offer monthly, quarterly, annual, or other subscription plans.
The applicable:
price;
billing frequency;
commitment period;
inclusions; and
renewal terms
will be presented before purchase.
Unless otherwise stated, subscription payments are collected in advance.
8. Automatic Renewal
Where you select a recurring membership, your membership will automatically renew at the billing interval shown during checkout until cancelled.
By purchasing an automatically renewing membership, you authorize GWW and its payment providers to charge your selected payment method for each renewal.
We may update subscription pricing from time to time.
Any material price change affecting your recurring membership will apply to a future renewal rather than retroactively to a period already paid for.
9. Cancellation
You may cancel an automatically renewing membership before your next renewal payment is processed.
Cancellation prevents future renewals.
Unless otherwise required by applicable law or expressly agreed by GWW, cancellation does not:
reverse a payment already processed;
create a prorated refund;
shorten an existing prepaid commitment; or
refund unused time in an active billing period.
Where a quarterly, annual, or other fixed-term commitment has already been purchased, cancelling prevents the next renewal but does not cancel the existing paid commitment.

10. Refunds
Because GWW reserves creative capacity and begins providing professional time, strategy, direction, and production once an engagement starts, payments are non-refundable after the applicable service period, project, or trial has begun.
Refunds will not normally be issued because:
you did not use the available service;
you submitted fewer requests than expected;
your priorities changed;
you delayed providing feedback;
required materials were not provided;
work took longer because of project complexity;
some queued requests remained unfinished at the end of a billing period; or
you decided not to continue using the service.
Nothing in these Terms limits any refund right that cannot legally be waived.
GWW may issue a refund or credit at its discretion. Doing so in one situation does not create an obligation to do so again.
11. Payments
Prices are shown before purchase.
You agree to provide accurate and current billing information and authorize our payment providers to process the applicable charges.
You are responsible for any taxes, currency-conversion charges, bank fees, or payment-processing costs that may apply to your purchase unless stated otherwise.
12. Failed Payments and Chargebacks
If a payment fails, is reversed, becomes overdue, or is disputed, GWW may pause or suspend Services until the issue is resolved.

before initiating a payment dispute or chargeback so we have an opportunity to investigate.
Fraudulent or abusive chargebacks may result in suspension or termination of Services.
13. Your Responsibilities
You agree to provide GWW with information reasonably required to perform the Services, including where applicable:
accurate briefs;
copy;
logos;
images;
video;
brand guidelines;
product information;
credentials;
stakeholder approvals; and
timely feedback.
You are responsible for ensuring that information and materials you provide are accurate and that you have the necessary rights to allow us to use them.
Client delays may affect delivery timelines without extending an active subscription, trial, or project period.
14. Client Materials
You retain ownership of materials you provide to GWW.
These may include:
logos;
trademarks;
photography;
video;
copy;
documents;
datasets;
brand assets; and
other proprietary materials.
You grant GWW a limited right to use those materials as reasonably necessary to provide the Services.
You represent that you have all necessary rights and permissions to provide those materials to GWW.
15. Ownership of Final Deliverables
Once all applicable fees have been paid in full, you receive the rights GWW owns in the final bespoke deliverables produced specifically for you, subject to the exclusions below.
This does not transfer ownership of GWW's:
pre-existing intellectual property;
internal systems;
processes;
templates;
methods;
frameworks;
workflows;
know-how;
reusable creative components;
software;
automation;
prompt libraries;
internal tools; or
third-party materials.
Where reusable GWW-owned components are incorporated into your final work, you receive the right to use them as part of the final deliverable.
Rights can only be transferred to the extent GWW legally owns or controls them.
16. Drafts and Unused Concepts
Unless otherwise agreed, GWW retains ownership of:
unused concepts;
rejected directions;
drafts;
working files not included in your plan;
internal explorations;
experiments; and
concepts not selected as final deliverables.
Purchasing an engagement does not automatically purchase every idea or concept explored during the creative process.
17. Source Files
Where applicable and included in your service, GWW may provide editable or source files.
Certain source files may contain third-party:
fonts;
software;
plugins;
templates;
stock media; or
other licensed assets.
Those components remain subject to their respective third-party licenses.
You may need to purchase separate licenses to continue using certain assets.
18. Third-Party Assets and Services
GWW may use or recommend third-party resources including:
fonts;
stock photography;
stock video;
music;
plugins;
software;
templates;
website platforms;
APIs;
AI services; and
other licensed resources.
These products and services remain subject to their own terms and licensing conditions.
Where a separate client license is required, you are responsible for obtaining it.
GWW is not responsible for the availability, performance, pricing, licensing, security, changes, or discontinuation of third-party services.
19. AI-Assisted Workflows
GWW is human-led and AI-accelerated.
Our team may use artificial intelligence and other technology where it helps improve speed, exploration, research, production, variations, image creation, workflow efficiency, or experimentation.
Human creatives remain responsible for creative judgment, direction, refinement, and final delivery.
Because AI technologies and laws continue to evolve, GWW does not guarantee that every AI-assisted element will qualify for exclusive copyright or intellectual-property protection in every jurisdiction.
Do not provide highly sensitive, legally restricted, classified, biometric, financial, medical, or similarly regulated information unless GWW has expressly agreed to handle it.
20. Confidentiality
Each party may receive confidential or non-public information belonging to the other.
Both parties agree to use reasonable care to protect confidential information and to use it only for purposes related to the engagement.
Confidential information does not include information that:
is publicly available through no breach of these Terms;
was already lawfully known;
is independently developed;
is lawfully obtained from another source; or
must legally be disclosed.
GWW may share necessary information with team members, contractors, and service providers who reasonably require access to deliver the Services.
Separate NDAs may be considered where required.
21. Portfolio and Promotional Use
Unless you request otherwise in writing, GWW may display publicly released final work created for you in:
our portfolio;
website;
social media;
case studies;
presentations;
promotional materials; and
award submissions.
We may also identify your company as a GWW client where appropriate.
GWW will not intentionally publish confidential, unreleased, private, or embargoed work without permission.

22. Final Approval
You are responsible for reviewing and approving final work before it is:
published;
advertised;
printed;
distributed;
presented;
launched; or
otherwise used commercially.
Your review should include, where relevant:
spelling;
names;
dates;
prices;
statistics;
links;
trademarks;
legal wording;
disclaimers;
regulatory claims;
product information;
financial information; and
factual accuracy.
Once work has been approved by you, GWW is not responsible for errors or omissions subsequently discovered except where applicable law provides otherwise.
23. No Guarantee of Results
GWW provides creative expertise, direction, production, and capacity.
We do not guarantee any specific commercial outcome.
This includes, without limitation:
revenue;
sales;
conversions;
leads;
advertising performance;
fundraising;
investor interest;
SEO rankings;
search visibility;
engagement;
impressions;
social media growth;
virality;
press coverage;
awards; or
customer acquisition.
Creative and marketing performance depends on many factors outside our control.
24. Professional and Regulated Advice
GWW is not your legal, financial, medical, investment, accounting, tax, regulatory, or compliance adviser.
If your creative contains regulated claims or professional information, you are responsible for obtaining appropriate specialist review before using the material.
25. Work Outside Standard Scope
Certain work may fall outside a standard GWW membership or require additional pricing.
Examples may include:
full software development;
application development;
complex product UI/UX;
advanced 3D production;
extensive website development;
large-scale rebranding;
complex animation;
long-form video production;
naming and trademark programs;
specialist production;
unusually large campaigns; or
exceptionally urgent or high-volume work.
Where appropriate, we will discuss additional scope or pricing before proceeding.
26. Communication
GWW is designed to operate efficiently and may use:
email;
messaging platforms;
project-management systems;
collaborative documents;
asynchronous communication; and
video calls
to work with clients.
Unless expressly included in your plan, unlimited requests do not mean unlimited calls or meetings.
27. Acceptable Use
You may not use GWW to create, distribute, or facilitate material that:
violates applicable law;
infringes another party's intellectual property;
is intentionally fraudulent or deceptive;
contains unlawful harassment or threats;
exploits children;
violates applicable trade or sanctions restrictions;
contains materials you do not have permission to use; or
creates unreasonable legal, security, or reputational risk for GWW.
We may refuse work we reasonably believe violates these Terms.
28. Service Availability
We aim to provide reliable Services, but we do not guarantee uninterrupted access to GWW, our website, project-management systems, communication tools, or third-party platforms.
Temporary interruptions may occur due to:
maintenance;
internet outages;
software failures;
third-party service disruption;
security incidents; or
circumstances outside our reasonable control.
29. Files and Storage
GWW is not intended to serve as your permanent file archive or backup provider.
You are responsible for downloading and safely storing important final deliverables.
We may retain project files for a reasonable period after an engagement ends but do not guarantee indefinite storage or future availability.
30. Non-Exclusivity
GWW may provide creative services to other businesses, including companies operating within industries similar to yours.
We will continue to protect confidential information in accordance with these Terms.
No exclusive relationship exists unless specifically agreed in writing.
31. Suspension and Termination
GWW may suspend or terminate Services where you:
fail to make payment;
materially breach these Terms;
repeatedly misuse the Services;
request unlawful work;
engage in abusive, threatening, or harassing conduct;
create material legal or security risk; or
substantially interfere with our ability to deliver Services.
Where reasonably possible, we will provide an opportunity to resolve the issue before termination.
If GWW terminates a prepaid engagement without cause, we may refund the reasonable unused portion of prepaid fees.
Where termination results from your breach, unused amounts may be non-refundable to the maximum extent permitted by law.
32. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the website and Services are provided on an “as available” basis.
Except where expressly stated, GWW makes no warranty that:
the Services will always be uninterrupted;
every requested deliverable will be completed within a specific period;
the Services will produce a particular business result;
every third-party service will remain available; or
every deliverable will be suitable for every platform, jurisdiction, or commercial purpose.
Nothing in these Terms removes rights that cannot legally be excluded.
33. Limitation of Liability
To the maximum extent permitted by applicable law, GWW and its team members, contractors, collaborators, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages.
This includes losses relating to:
profits;
revenue;
business opportunities;
goodwill;
expected savings;
data; or
commercial performance.
To the maximum extent permitted by law, GWW's total aggregate liability arising out of or relating to the Services will not exceed the fees actually paid to GWW for the Services giving rise to the claim during the three months immediately preceding the event giving rise to the claim, or the amount paid for the relevant project or trial where applicable.
Nothing in these Terms excludes liability that cannot legally be excluded or limited.
34. Indemnification
You agree to indemnify and hold harmless GWW and its team members, contractors, collaborators, and representatives from third-party claims, liabilities, losses, damages, and reasonable legal costs arising from:
materials supplied by you;
your products or services;
instructions you provide;
statements or claims you instruct us to publish;
infringement caused by client-provided materials;
your unlawful use of the Services; or
your breach of these Terms.
This applies only to the extent the relevant claim was not caused by GWW's own unlawful conduct.
35. GWW Intellectual Property
The Good Weird Works name, logo, identity, website, copy, graphics, original content, portfolio presentation, systems, processes, and related intellectual property are owned by or licensed to GWW.
You may not reproduce, republish, scrape, redistribute, resell, impersonate, or commercially exploit GWW's proprietary materials without permission.
36. Feedback and Testimonials
If you voluntarily provide feedback, suggestions, reviews, or testimonials to GWW, you permit us to use them for legitimate business and promotional purposes.
We may edit testimonials for formatting, spelling, length, or clarity provided we do not materially misrepresent their meaning.

37. Privacy
Our handling of personal information is governed by our separate Privacy Policy.
We may use third-party providers where reasonably necessary to:
process payments;
schedule meetings;
manage projects;
communicate with you;
host services;
perform analytics; and
operate GWW.
Please review the Privacy Policy for more information.
38. Independent Relationship
GWW provides Services as an independent service provider.
Nothing in these Terms creates an:
employment relationship;
legal partnership;
joint venture;
franchise;
fiduciary relationship; or
exclusive agency relationship
between you and GWW.
39. Force Majeure
Neither party will be responsible for delays or failures caused by events reasonably outside its control.
These may include:
natural disasters;
widespread internet outages;
major platform failures;
war;
terrorism;
civil unrest;
government action;
public-health emergencies;
power failures;
labour disruption; or
failure of critical third-party infrastructure.
This does not remove payment obligations for Services already provided.
40. Changes to Our Services
We may modify our:
Services;
features;
plan structures;
pricing;
processes; or
operating model
from time to time.
Changes will not retroactively alter a service period that has already been paid for.
Material changes to recurring pricing will generally apply at a future renewal.
41. Changes to These Terms
We may update these Terms from time to time.
The latest version will be published on our website with an updated revision date.
Where appropriate, material changes affecting active customers will apply prospectively.
Continued use of GWW after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.
42. Additional Agreements
Your engagement may also be governed by a:
proposal;
order form;
statement of work;
NDA;
data-processing agreement; or
other written agreement.
Where a separately signed written agreement expressly conflicts with these Terms, that agreement will control for the specific engagement.
43. Electronic Communications
You agree that communications relating to GWW may be provided electronically.
This may include:
agreements;
invoices;
approvals;
notices;
payment confirmations;
subscription information; and
other communications.
Your electronic acceptance, purchase, or use of the Services may constitute acceptance of these Terms.
44. Disputes
If a dispute arises between you and GWW, both parties agree to first attempt to resolve it in good faith through direct written communication.

If a dispute cannot be resolved informally, either party may pursue remedies available to it under applicable law.
Nothing in these Terms prevents either party from seeking urgent relief where reasonably necessary to protect intellectual property, confidential information, or prevent immediate harm.
45. Applicable Law
These Terms and your use of the Services are subject to applicable law.
Nothing in these Terms removes or restricts any right, protection, or remedy that cannot legally be waived.
46. Assignment
You may not transfer or assign your rights or obligations under these Terms without our written consent.
GWW may transfer or assign its rights or obligations in connection with a restructuring, acquisition, sale, transfer of the business, or similar transaction.
47. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect.
Where legally possible, the affected provision will be interpreted as closely as possible to its original commercial purpose.
48. No Waiver
Our failure to enforce any part of these Terms does not waive our right to enforce it later.
49. Entire Agreement
These Terms, together with your applicable order, proposal, Privacy Policy, and any separately signed agreement, form the agreement between you and GWW concerning the Services.
They replace prior discussions or understandings relating to the same subject matter.
